TERMS AND CONDITIONS
1. Scope of Application
1.1 These Terms and Conditions apply to all legal transactions between Movidamente S.A. and its contractual partners, hereinafter referred to as “the contractual partner”.
1.2 For online transactions, including bookings and purchases of digital or physical products (books, videos, seminars), the contractual partner accepts these Terms and Conditions as well as, where applicable, the terms and conditions of Digistore24 or other authorized sales partners. Acceptance occurs through electronic confirmation during the ordering process. If no written objection is raised, the contract is concluded under these Terms and Conditions.
2. Subject Matter of the Contract
2.1 Movidamente S.A. offers seminars, books (paperback and digital formats), and video-based training materials. Digital products include downloads and online-accessible content.
2.2 Seminars may be conducted on-site or online. If on-site seminars cannot take place due to external circumstances (e.g. force majeure, illness, regulatory restrictions), they may be conducted online as a substitute without giving rise to claims for compensation or contract cancellation. Dates, formats, locations, and content are subject to change.
3. Conclusion of Contract
Seminar Bookings
3.1 A contract for seminar participation is concluded upon confirmation of participation (in writing, electronically, or verbally with written follow-up), issuance of an invoice, and payment of the non-refundable registration fee.
3.2 Seminar participation requests are subject to availability. Confirmation is provided by invoice issuance and payment of the registration fee.
3.3 The registration fee is non-refundable and covers administrative costs. Payment constitutes acceptance of these Terms and Conditions.
3.4 The remaining seminar fee is due no later than ten (10) days before the seminar start date.
3.5 Movidamente S.A. reserves the right to postpone seminars due to force majeure or other significant reasons. Participants will be offered up to three alternative dates within one year.
3.6 If no alternative dates can be offered, the seminar fee (excluding the registration fee) will be refunded.
Online Purchase of Books and Videos
3.7 Contracts for online purchases are concluded upon acceptance of the Terms and Conditions and confirmation of the order.
3.8 Sales of digital products are processed via Digistore24 or other authorized sales partners and are subject to their respective terms and conditions.
3.9 Prior to completing the order, the contractual partner consents to data processing, acceptance of these Terms and Conditions, applicable partner terms, the privacy policy, and waives the right of withdrawal for digital content where legally applicable.
4. Contract Duration and Remuneration
4.1 The contract begins upon conclusion under Section 3 and ends upon fulfillment by both parties.
4.2 Prices are based on the rates valid at the time of contract conclusion.
4.3 Physical and digital products must be paid in advance.
4.4 Seminar payment and refund conditions are governed by Section 3.
4.5 Prices include applicable taxes unless otherwise stated. For non-EU transactions, prices may be exclusive of VAT depending on legal requirements.
5. Scope of Services and Unused Services
5.1 The scope of services is defined by the individual contract or offer.
5.2 Unused services do not entitle the participant to a refund.
5.3 As a gesture of goodwill, alternative seminar dates may be offered.
6. Participation Conditions for Seminars
6.1 Participants may be excluded from events for disruptive or inappropriate behavior. No refund will be issued in such cases.
6.2 Instructions given by trainers or seminar leaders must be followed.
6.3 Participation may involve physical activity. Participants are responsible for assessing their own health and fitness prior to participation.
6.4 Participation is at the participant’s own risk.
6.5 Participation under the influence of alcohol or narcotics is prohibited.
6.6 Health conditions must be disclosed prior to participation.
6.7 The organizer reserves the right to exclude participants with evident health risks.
6.8 Participants must cooperate to minimize potential damage and report issues immediately.
6.9 Participants are responsible for their own accident and liability insurance.
7. Right of Withdrawal and Returns
7.1 Physical products may be returned unopened. Shipping and return costs are borne by the buyer.
7.2 Seminar withdrawal conditions are governed by Section 3.
7.3 Digital products are excluded from withdrawal after access has been granted, except in cases of technical failure.
8. Copyright and Intellectual Property
8.1 Neurotango® is a registered trademark in the European Union, the United Kingdom, Argentina, and with registrations filed in Paraguay.
8.2 All materials are protected by copyright. Reproduction, distribution, or sharing without written permission is prohibited.
8.3 Seminar materials may not be recorded, reproduced, or distributed without explicit consent.
8.4 Images or videos may only be created and shared with explicit consent of all participants and the organizer.
9. Liability
9.1 Movidamente S.A. is liable for intent and gross negligence in accordance with applicable law.
9.2 Liability for slight negligence is limited to foreseeable damages typical of the contract.
10. Place of Jurisdiction
10.1 Paraguayan law applies exclusively.
10.2 Place of performance and jurisdiction is Asunción, Paraguay.
11. Other Provisions
11.1 No ancillary agreements exist. Amendments must be made in writing.
11.2 Contractual claims may not be assigned without consent.
12. Severability Clause
If any provision of these Terms and Conditions is held invalid, the remaining provisions remain unaffected. The invalid provision shall be replaced by a valid one that most closely reflects the original intent.
Certification
The Neurotango® Practitioner Certification is granted exclusively upon fulfillment of all certification requirements as defined by Movidamente S.A.
Certification requires:
- the complete and lawful acquisition of all required training materials
- the personal use of the materials; sharing, transfer, or use of materials acquired by third parties is not permitted
- the full completion of all required questionnaires and assignments
- participation in a certification seminar or assessment session, including the presentation of an individual concept
The individual concept must demonstrate sufficient understanding of:
- the structure and logic of the Neurotango® tool system
- the appropriate selection and application of tools
- the professional use of the method within the participant’s individual field of practice Certification is awarded only if the participant demonstrates that the tools and the underlying system have been understood and can be applied responsibly and independently within a professional context.
Movidamente S.A. reserves the right to deny or postpone certification if the required criteria are not met.
Certification does not grant ownership of the materials, nor does it permit redistribution, sublicensing, or independent certification of third parties.
